Why does having an accident with an uninsured motorist complicate coverage?

State law also requires that all drivers carry minimum coverage for UM/UIM collisions for their own protection in the following amounts:

  • $15,000 for injuries suffered by a single person in the accident
  • $30,000 for injuries suffered by all those injured in the accident
  • $5,000 for property damage caused by the accident

You may also choose to purchase UM/UIM coverage over and above the minimum amount required, but only up to the amount of your regular insurance coverage for liability and property damage. If the driver responsible for your property damage and/or injuries is uninsured, you will be able to file a claim under your UM policy quickly. If, however, the other driver is underinsured (i.e. has insurance, but not enough to cover the full amount he/she is liable for), you must first file a claim with the other driver’s insurance company. Only after you have exhausted the other driver’s coverage will you be permitted to file a claim on your own UM/UIM policy for the difference.
